$10 Million Per Unit Spent as ARPA Bypassed Procurement Rules

Oversight was stripped away via Section 845 Authority to build a stealth drone for precision strikes, a process that allowed a one-page specification to justify $10 million per unit.
A one page specification. That was the genesis of the RQ-3A DarkStar, a high-altitude endurance unmanned aerial vehicle designed to penetrate the most sensitive airspace on earth. According to a program description mirrored by the FAS Intelligence Resource Program, that single page simply defined the best altitude, endurance, and signature for a unit cost of $10 million for copies 11 through 20.
The goal was a vehicle optimized for reconnaissance in "highly defended areas." It was designed to be a ghost in the sky, providing what the government called "affordable, near real time, continuous, all weather, wide area surveillance." The intended end user was the tactical commander, who could use this intelligence to perform "precision strikes and other high priority intelligence and reconnaissance tasks."
"Highly Defended Areas"
The DarkStar was not meant for the open plains or the low-threat environments where the Tier II Plus UAV would operate. It was built for the breach. Physically, the aircraft was a compact predator, measuring a little over half the span and a third the length of the Global Hawk. It was designed to operate at altitudes exceeding 45,000 feet, loitering over a target for more than eight hours with a range of 500 nautical miles from its launch site.
To achieve this, the government commissioned a partnership between two of the largest names in the military-industrial complex. A Lockheed/Boeing team led the development. Boeing’s Military Aircraft Division in Seattle handled the wings and wing subsystems, while Lockheed Martin’s Skunk Works in Palmdale took charge of the body, final assembly, and system testing. Power was provided by a single turbo-fan engine from Williams International.
The surveillance capability was stripped down for the sake of stealth. While the Global Hawk could carry both synthetic aperture radar (SAR) and electro-optical (EO) sensors simultaneously, the DarkStar could carry only one at a time—a 1,000-pound payload from either Northrop Grumman or Recon Optical. The antennas were installed to maintain low observables, which the record notes resulted in less bandwidth for communication links. The imagery these sensors captured was then fed through a Common Ground Segment developed by Raytheon/E-Systems, which distributed the data to various service-specific processors: ETRAC and MIES for the Army, CARS for the Air Force, and JSIPS-N for the Navy and Marines.

The ambition of the program quickly collided with the reality of physics. The DarkStar’s first flight occurred in March 1996, but the second flight in April 1996 ended in a crash. The cause was blunt: "incorrect aerodynamic modeling of the vehicles flight control laws."
In the wake of the crash, the project didn't stop; it was audited. An independent review was conducted by a group of experts from government, industry, and academia. By December 22, 1996, Undersecretary of Defense for Acquisition and Technology Paul G. Kaminski approved a revised program plan. The review concluded that the contractor team understood the cause of the accident, that the simulations now matched the flight data, and that the processes for software development and system testing had been "significantly improved."
This cycle of failure and "expert" validation is a common rhythm in high-stakes defense spending, but the DarkStar was unique in how it was funded and shielded from the standard rules of government acquisition.

Section 845 Authority
The Tier III Minus program—the official designation for the DarkStar—was the first project executed under the "Section 845 Authority" granted to ARPA. This specific legal carve-out was designed for prototype weapons development. In the language of the program description, this authority "paved the way for unprecedented government-industry collaboration by removing the burden of specialized Defense procurement regulations and statutes."
When the government speaks of "removing the burden" of regulations, it is usually referring to the removal of oversight. Section 845 allowed ARPA and its contractors to bypass the very statutes intended to prevent cost overruns and ensure technical viability before millions of taxpayer dollars were sunk into a prototype. The result was a development environment where a one-page specification was sufficient to launch a $10 million-per-unit program.
Despite the revised plans and the improved simulations, the DarkStar could not outrun its own contradictions. The Air Force eventually faced a trade-off between the stealth of the DarkStar and the range of the Global Hawk. They chose the range.
A second DarkStar UAV did eventually complete a test flight on June 29, 1998. It was a brief victory. In February 1999, the Department of Defense canceled the program due to budget cuts.
